A. Mission and Overview

Sandman Sports, LLC (“Sandman”, “we”, “our”, or “us”) exists to bring people together for friendly, well-run sports contests and informed picks and analysis. We emphasize clear rules, fair play, safety, and transparent results so every User (as defined below) knows what to expect and how to succeed.

By creating an account, or otherwise accessing and using the services, you as the account owner or use (hereafter “you”, “yours”, or “User”) agree to be bound by these House Rules (“Rules”), Privacy Policy, General Terms of Use, Responsible Gaming, and all other corporate and legal policies in effect at the time of each Contest entry (collectively, the “Terms”).

The Terms, together with any additional terms, addendums, or documents that may be referenced herein, form an agreement between you and us in connection with the services. Any capitalized terms not defined herein shall be given the meaning ascribed to them in the Terms. IF YOU DO NOT AGREE TO THE TERMS, THEN YOU MUST NOT ACCESS OR OTHERWISE USE THE SERVICES.

WE ENCOURAGE YOU TO READ THE OFFICIAL RULES THAT GOVERN EACH OF OUR CONTESTS (“OFFICIAL CONTEST RULES”), AS THEY FORM AND ARE A PART OF THESE RULES AND VARY FROM CONTEST TO CONTEST. OFFICIAL CONTEST RULES WILL BE AVAILABLE ON THE CONTEST DETAILS PAGE OR THROUGH LINKS PROVIDED ON THE SANDMAN PLATFORM. IN THE EVENT OF ANY AMBIGUITY OR CONFLICT BETWEEN THESE RULES AND ANY OFFICIAL CONTEST RULES, THE OFFICIAL CONTEST RULES SHALL TAKE PRECEDENCE. SANDMAN RESERVES THE RIGHT TO CREATE, MODIFY, RETIRE, OR REPLACE OFFICIAL CONTEST RULES AT ANY TIME.

B. Key Definitions

“All-Star Badge” is the symbol displayed next to a Highly Experienced User’s username in the lobby of the Sandman Sports Site.

“Beginner User” is a user who has played in 50 or less Contests on the Sandman Sports Site and Contest pages.

“Contest(s)” are the contests available on the Sandman Sports Site and includes both Private Contests and Public Contests.

“Commissioner” means any Sandman approved individual or entity who creates (within the parameters of the available Contests on the Sandman Sports Site), manages, and administers Private Contests and certain Public Contests through the Sandman Sports Site.

“Commissioner-created Contests” are Contests created by a Commissioner.

“Eligibility Criteria” means the eligibility provisions in the General Terms of Use.

“Experienced User” is a user who has (i) played in between 51 and 999 Contests on the Sandman Sports Site, (ii) won $1,000+ in at least two (2) Contests on the Sandman Sports Site, or (iii) won $10,000+ in total prizes across all Contests.

“Highly Experienced User” is a user who has (i) played in 1,000 or more Contests on the Sandman Sports Site, (ii) won $1,000+ in at least three (3) Contests on the Sandman Sports Site, or (iii) won $25,000+ in total prizes across all Contests.

“Official Contest Rules” are rules specific to a Contest, the baseline of which are housed on the Sandman Sports Site. Sandman, in its sole discretion, shall determine which specific variables of the Official Contest Rules are subject to adjustment by a Commissioner.

“Private Contest(s)” are Commissioner-created Contests which are not open to the public, as further defined in Section G herein.

“Public Contest(s)” are open to the public as further defined in Section G herein.

“Rookie Badge” is the symbol displayed next to a Beginner’s username in the lobby of the Sandman Sports Site and Contest pages.

“Sandman-created Contests” are Contests in which Sandman Sports creates, manages, and administers certain Public Contests through Sandman Sport’s platform and administrative service provider.

“Sandman Sports Site” refers to https://www.sandmansports.com/ and any of its affiliated websites, through which we offer sports pools, tips, tools, content, free-to-play games, paid-entry contests of skill, and other games, tools, content, products and services.

“Sandman Treasury” is the third-party payment administration structure which collects User fees and executes Contest prize payouts for the benefit of Users and Commissioners as required per the Official Contest Rules, separate and apart from Sandman operational funds.

“Veteran Badge” is the symbol displayed next to an Experienced User’s username in the lobby of the Sandman Sports Site and Contest pages.

C. One Account Per User

You may establish, maintain, use and control only one (1) account with Sandman. Each account with Sandman may only be owned, maintained, used and controlled by one individual. Your account is unique to you and non-transferable. For the avoidance of doubt, users may not “co-own” accounts with another person or entity on this site. You accept responsibility for all activities that occur under your account and/or from your devices. In the event Sandman determines that you have opened, maintained, used or controlled more than one account, in addition to any other rights that Sandman may have, Sandman reserves the right to suspend or terminate any or all of your accounts and terminate, withhold or revoke the awarding of any prizes.

D. User Skill Tiers

Sandman offers various services for Users of all skill levels (amateur to professional levels) and wants Users of similar skill and experience to compete with those Users who have similar skill and experience in order to encourage competition and fair play. For that reason, Sandman employs a user rating and identification system which separates Users into three (3) experience level tiers: (1) Beginner Users, (ii) Experienced Users, and (iii) Highly Experienced Users (each a “User Skill Tier”). Each User Skill Tier has its own badge and criteria as set forth on Exhibit A.

E. Contest Types and Contest Status

Sandman offers a wide range of Contest Types which are each more specifically described in Exhibit B. Contests may take place on a single day, over multiple days, one week, several weeks or for an entire season depending on the Contest Type. Please check the Official Contest Rules before Contest entry as each Contest Type has its own rules, policies, and eligibility. IF ANY TERMS HEREIN CONFLICT WITH OFFICIAL CONTEST RULES, THE OFFICIAL CONTEST RULES APPLY.

Contest Status icons will be available to Users when viewing the available Contests in the lobby of the Site, as displayed using the legend set forth on Exhibit C.

F. Contest Operations

Prior to competing in a Contest, Sandman provides the following information to Users regarding contest operations:

  • Name of the Contest & Contest ID number
  • Contest start date & time and end date & time
  • Sport(s) involved in the Contest
  • Available roster size
  • Prize(s)
  • Official Contest Rules

G. Public and Private Contests

Sandman offers both Public Contests and Private Contests. Public Contests will either be Commissioner-created Contests or Sandman-created Contests. Private Contests will be Commissioner-created Contests only. Exhibit D provides a diagram of these distinctions.

Public Contests (Commissioner-created or Sandman-created)

Ninety Five Percent (95%) of Public Contests are open to any User, regardless of User Skill Tiers, subject to the Eligibility Criteria. In order to preserve fair play, all Users will still be able to see the User Skill Tier of another User and agree to compete with Users of any User Skill Tier by participating in that Contest.

Three Percent (3%) of Public Contests are open to Beginner Users only, subject to Eligibility Criteria (“Rookie Contests”). No Experienced User or Highly Experienced User will be eligible to enter Rookie Contests. Sandman will notify Beginner Users when Rookie Contests become available. Rookie Contests will be tagged as a “Rookies Only” contest under the Contest Status.

Two Percent (2%) of Public Contests are open to Beginner Users and Experienced Users only, subject to Eligibility Criteria (“Advanced Rookie Contest”). No Highly Experienced User will be eligible to enter Advanced Rookie Contests. Sandman will notify Beginner Users and Experienced Users when an Advanced Rookie Contest becomes available.

Public Contests are further governed by the Official Contest Rules applicable to that Contest. Sandman reserves the right, subject to applicable law and Official Contest Rules, to cancel, modify, resize, guarantee, overlay, or refund Public Contests as necessary. For the avoidance of doubt, Sandman in its sole and absolute discretion may resize or modify the prize payout for Commissioner-created Contests based on the number of Users who join the Contest.

Private Contests (Commissioner-created)

All Private Contests are open to any User, regardless of User Skill Tiers. In order to preserve fair play, the User Skill Tier of all Contest Users will be visible, and you therefore agree to compete with Users of any User Skill Tier by participating in that Contest.

Treasury Services

You acknowledge that all Public Contests and Private Contests in which the Commissioner so elects shall use Sandman Treasury services. Sandman shall make reasonable efforts to direct the Sandman Treasury to release Contest prizes to the applicable User(s) but reserves the right to delay, withhold, reverse, adjust, or refuse said prize by and through direction to the Sandman Treasury if necessary to investigate fraud, rule violations, payment disputes, technical issues, compliance concerns, or other circumstances that may affect contest integrity. Subject to the above, you waive any and all claims against Sandman arising out of and related to the acts or omissions of Sandman Treasury.

H. Commissioner-Created Contests

You acknowledge that Sandman’s primary responsibility in Commissioner-created Contests is to provide the infrastructure upon which the Commissioner shall administer the Contest. Commissioners are responsible for, amongst other things, modifying or supplementing Official Contest Rules, including but not limited to modifying Contest settings, establishing entry fees, prize structures, eligibility requirements, and other Contest-specific terms, subject to Sandman approval and platform limitations. Sandman shall not be responsible for claims or disputes arising out of or related to Commissioner-created Contests. Sandman may, upon request and in its sole discretion, review the matter and provide guidance to the Commissioner regarding an appropriate resolution. You shall defend, indemnify and hold harmless Sandman, its owners, affiliates, and partners from any claims, disputes, liabilities, damages, or expenses arising out of or related to the administration of Commissioner-created Contests, including but not limited to any guidance Sandman provides regarding said claims or disputes.

Commissioners shall not create Contests that contain misleading information, unlawful content, discriminatory eligibility requirements, inappropriate material, or any rules that conflict with the Terms. Sandman reserves the right to reject, suspend, modify, remove, or cancel any Commissioner-created Contest that violates the Terms, applicable law, platform policies, or the integrity of the Sandman platform. Sandman reserves the right to modify, suspend, or revoke Commissioner privileges at any time and for any reason.

Your participation in any Commissioner-created Contest is subject to the Official Contest Rules as amended by the Commissioner. You should contact the Commissioner if you have any questions or concerns regarding the administration of such Contest, including but not limited to customized rules and settings, scoring options, entry requirements, and prize structures.

I. Eligibility Criteria

You represent and warrant that, throughout any period in which you access or participate in the Contests, that you satisfy the Eligibility Criteria contained in the General Terms of Use and any additional eligibility requirements or regulations associated with such Contests in the jurisdiction in which you are located.

Sandman is not currently available in all US states and Canadian provinces. Please check “Where Can I Play” for up-to-date information and announcements about new state launches. Exhibit B sets forth jurisdiction restrictions for specific Contest Types.

WE MAKE NO REPRESENTATION THAT PARTICIPATION IN THE CONTESTS IS LAWFUL IN ANY PARTICULAR STATE AND/OR JURISDICTION.

J. Statistics and Scoring

Sandman uses official statistics and results provided by its designated data providers and the applicable governing sports leagues. All “live” statistics and other information provided through the services and related information sources are unofficial. Only statistics and outcomes recognized as official by the applicable league or governing body will be used for contest scoring purposes.

While Sandman and the third parties use reasonable efforts to include accurate and up-to-date information, Sandman cannot and does not guarantee the accuracy of the data used.

K. Canceled, Postponed, Rescheduled, Suspended and Shortened Events

Sandman may, in its sole discretion, determine how canceled, postponed, rescheduled, suspended, shortened, or otherwise modified sporting events are treated for Contest purposes.

If a league declares a game “postponed” or “suspended”, the Users, for statistics generated in the sporting event prior to the decision to postpone or suspend, will receive zero points, statistics, credit, or advancement toward Contest objectives in the event the sporting event (i) never resumes, (ii) resumes after the relevant Contest period closes, or (iii) is deemed “cancelled” or “rescheduled” by the relevant league. For the removal of doubt, if a league declares a game “postponed” or “suspended”, the statistics generated in the sporting event before that point will count toward the Contest’s objectives only if the sporting event resumes from that point in the event and resumes before the relevant Contest period closes. In addition, if a league shortens an event and deems scoring official, the statistics generated in the shortened event will count toward the Contest’s objectives.

If schedule changes, cancellations, postponements, or other unforeseen circumstances materially impact a Contest, Sandman reserves the right to modify Contest scoring, adjust Contest structures, extend scoring periods, disable or cancel Contests, issue refunds, or take any other action deemed necessary to preserve the integrity of the Contest.

L. Contest Lock & User Entry Cancellation

Contest Lock Times and Entry Deadlines

Contest entry deadlines and selection lock times vary by Contest Type and are displayed within each Official Contest Rules.

Unless otherwise specified in the Official Contest Rules, selections for a particular athlete, team, game, event, or matchup will lock at the scheduled start time of that game, event, or matchup. Once a selection has locked, it may not be modified. However, certain Contests may permit Users to make or modify selections for future games or events that have not yet started, even if earlier selections within the same Contest have already locked. See the Official Contest Rules for any Contest-specific lock rules.

Contest Modifications, Cancellations and Refunds

All payments are non-refundable, and no cancellations or refunds are permitted unless explicitly provided by Sandman in its sole discretion.

In the event a Contest does not reach its advertised minimum User participation requirements, Sandman reserves the right to (i) proceed with the number of participants entered, (ii) resize, with User limits, contest structure, bracket size, and/or prize payouts, (iii) cancel Contests, with all entry fees refunded or (iv) modify as disclosed in the applicable contest settings. IF ANY TERMS HEREIN CONFLICT WITH OFFICIAL CONTEST RULES, THE OFFICIAL CONTEST RULES APPLY.

M. Lineup Restrictions

If lineups are applicable to a Contest, player position eligibility is determined at the sole discretion of Sandman. Lineups must include players from at least two different teams, unless otherwise posted in the Official Contest Rules. Sandman does not offer Contests with pre-selected lineups.

N. Ties / Dead Heat Rules

Unless otherwise posted in the Official Contest Rules, any Users that remain tied at the conclusion of a Contest will evenly split the combined prize allocation for the finishing spots they occupy. For example, if two Users tie for first place, those two Users would evenly split the combined prize for first and second. If four Users tie for second place, those four Users will evenly split the combined prize for second, third, fourth, and fifth place.

O. Multiple Entry Limitations (Public Contests only)

If a Public Contest allows a User to submit multiple entries, the maximum number of entries per User is as follows:

13 to 36 total entries 2 entries per User
37 to 100 total entries 3 entries per User
More than 100 entries 3% of all entries (rounded to the nearest whole number) or 150 entries, whichever is less

These multiple entry limitations are set restrictions on the intended number of total entries at the time of Public Contest creation. See the Official Contest Rules for specific multiple entry limitations. We reserve the right to change multiple entry limitations at any time.

P. Prizes

After each Contest ends, the tentative winners are announced but remain subject to final verification. The winning User as determined by the Official Contest Rules, and complies with Eligibility Criteria and Terms, will be entitled to the applicable prize as set forth in the Official Contest Rules. In the event of a tie, the prize is divided evenly between the tied Users, unless otherwise specified. Prizes are added to the winning User’s account balance.

Prize winners are determined by the official statistics in effect at the time Sandman posts final Contest results. Once the winning User(s) is announced by Sandman, the results will not be adjusted, notwithstanding any statistical adjustments made by the professional leagues, data providers, or otherwise. However, Sandman reserves the right to adjust results based on errors or irregularities in the transmission of information to us from our stats provider or in our calculation of results. We also reserve the right to make adjustments in the event of noncompliance with the Terms, including but not limited to announcing a new winning (and compliant) User and we reserve the right to reverse payments in the event of any adjustment. You agree to cooperate with our decision to reverse payments. Sandman has no obligation to delay the posting of final Contest results in anticipation of any statistical adjustment.

When you receive a prize payment as a result of your participation (and success) in any Contest, you are liable to us for the full amount of the prize payment to you plus any fees if the payment is later invalidated or reversed for any reason. Should you violate any of the conditions set forth in these Rules, and such violation(s) result in your unjust enrichment, you hereby appoint us to serve as your attorney-in-fact for the purpose of either withdrawing funds from your account or processing a charge to one of your stored methods of payment in order to recoup the amount improperly obtained and/or withdrawn plus fees.

For each Contest, the entry fees and prizes will be identified in advance in the Official Contest Rules. A list of all currently open Contests, along with entry fees and prizes, can be found in the main lobby of the Site. Guaranteed prizes are offered in connection with some of the Contests offered by the Site.

Prizes will only be awarded upon the completion of a Contest as determined by the Official Contest Rules. We reserve the right to cancel Contests at any time. In the event of a cancellation, all entry fees will be refunded to the User except as otherwise provided herein.

No substitution or transfer of a prize is permitted. All taxes associated with the receipt or use of any prize are the sole responsibility of the winning User(s). In the event that the awarding of any prizes to winners of a Contest is challenged by any legal authority, Sandman reserves the right in its sole discretion to determine whether or not to award or adjust such prizes. In all claims or disputes arising out of or related to the Contests (including but not limited to determination of the winning User(s)), Sandman shall the sole arbiter, and its decisions are final and binding.

Drawing Rules for Non-Cash Prizes

Certain Sandman-created Contests may award non-cash prizes to winners such as trips, gift cards, merchandise or Sandman credit. In the event of a tie for such a prize, Sandman Sports will make reasonable efforts to split the prize amongst the tied Users. However, in the event where multiple Contest Users finish tied for a non-cash prize that cannot be reasonably split, Sandman will conduct a drawing using an online randomizer platform (“Drawing”) to determine which User shall be awarded the prize. Within 72 hours of the Drawing, Sandman shall post the results on the Site and notify the winning User, in writing, who shall be awarded the prize within 72 hours of the Drawing.

Sandman reserves the right, in its sole discretion, to:

  1. determine whether a non-cash prize can be reasonably split among tied Users or to conduct a Drawing to break the tie; and
  2. choose the online randomizer platform to conduct the Drawing.

Q. Free to Play Games

Sandman reserves the right to invite certain Users to participate in contests it administers with no entry fee. Each free contest is governed by its own set of official rules, which rules shall supersede these House Rules in the event of any conflict.

R. Fair Play & Prohibited Conduct

When accessing and/or using our services, you agree that you will not: (a) use our services for fraudulent or abusive purposes; (b) use our services in violation of any applicable law, regulation, or requirement, and/or the intellectual property, privacy, or similar rights of us or any other person; or (c) otherwise take any action that you know or reasonably should know is improper, unfair, fraudulent, or otherwise adverse to the operation of the Service or in any way detrimental to us or other users. Without limitation, you agree not to:

  • Create, or attempt to create more than one (1) account;
  • Sell or otherwise transfer your profile;
  • Sell, or otherwise advertise for sale, any goods and/or services, without the explicit written consent of Sandman;
  • Use an account that does not belong to you;
  • Falsify any personal information required to: create an account, enter a promotion, and/or claim a prize;
  • Use the services for any illicit, illegal, and/or fraudulent purposes;
  • Collude with any other individual(s) in an attempt to circumvent these Rules;
  • Use our services in any way that accumulates points or prizes through unauthorized methods such as unauthorized scripts or other automated means, or to cheat or design or assist in cheating;
  • Disguise, anonymize, or hide your IP address and/or the source of any user content that you may upload;
  • Crawl or scrape the services in any way, shape, or form, for any purpose whatsoever, without the express written consent of Sandman;
  • Monitor, use, or copy the services and/or any content posted to the Site, including but not limited to information about or regarding other people that use our services, or upload anything that collects information including but not limited to ‘pixel tags’ and cookies;
  • Remove or amend any proprietary notices or other ownership information from our services or attempt to decompile, reverse engineer, disassemble or hack any of our services;
  • Defeat or overcome any of our encryption technologies or security measures or otherwise circumvent technological measures designed to control access to, or elements of, our services or upload or submit to the services software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment and/or in any way harm another Sandman user and/or Sandman;
  • Use our services for any commercial or business purpose or for the benefit of any third party or to send unsolicited communications;
  • Send any unlawful, threatening, abusive, harassing, defamatory, obscene, and/or otherwise objectionable messages;
  • Impersonate any person or entity, and/or misrepresent your affiliation with any person or entity;
  • Violate any provision of these Rules; and/or
  • Misuse the services in any way, including but not limited to, abusing Sandman customer support and/or other employees.

If we have reason to suspect or learn that you are violating these Rules, we may take any and all action, including but not limited to restricting in whole or in part your use of the services, and/or taking legal action as necessary to recover any and all damages caused by the violation.

S. Identity Verification, Responsible Play, Payment Processing & Compliance

Sandman maintains identity verification, anti-fraud, anti-money laundering, geolocation, payment monitoring, and compliance programs designed to protect Users and preserve the integrity of the platform.

Users may be required to provide documentation to verify identity, age, residency, payment methods, account ownership, source of funds, or other information requested by Sandman. Sandman reserves the right to delay withdrawals, suspend account activity, restrict transactions, request additional documentation, or conduct compliance reviews at any time.

Failure to cooperate with verification or compliance requests may result in account suspension, account closure, forfeiture of prizes where permitted by law, or other account restrictions.

You agree to indemnify, release, defend, and hold harmless Sandman and its parents, subsidiaries, affiliates, and agencies, as well as the officers, directors, employees, shareholders and representatives of any of the foregoing entities, from and against any and all losses, liabilities, expenses, damages, costs (including reasonable attorneys’ fees and court costs), claims, and/or actions of any kind whatsoever arising or resulting from your use of the services, your violation of these Rules (including but not limited to violations of these Responsible Play and Payment Processing Compliance provisions), and your receipt, ownership, and use or misuse of any prize. Sandman reserves the right to assume exclusive defense and control of any matter otherwise subject to indemnification by you and, in such case, you agree to cooperate with Sandman in the defense of such matter.

Responsible Play

Sandman encourages responsible participation. Users should only participate with funds they can afford to lose and should view Contests as entertainment rather than a source of income.

Sandman may offer tools designed to assist Users in managing participation, including deposit limits, self-exclusion options, cooling-off periods, and account restrictions where required by law. Individuals seeking assistance related to problem gaming should consult available support resources, including the National Council on Problem Gambling or by calling 1-800-GAMBLER.

Please consult our Responsible Play Terms and Conditions for information on self-exclusion, limits on play, help with addictive behavior, and other related items. We reserve the right, in our sole and absolute discretion, to determine whether you are utilizing our services in a responsible way in accordance with our Responsible Play Terms and Conditions. We shall permit you to set responsible play limits and to self-exclude. Notwithstanding the foregoing, we reserve the right, in our sole and absolute discretion, to impose stricter responsible play limits than those imposed by you and to exclude you, if we deem it necessary.

T. Data Sources, Analytics & Rule Amendments

Statistics, projections, rankings, salary values, Contest information, analytics, and other data displayed by Sandman may be provided by third-party data providers. While Sandman strives to provide accurate information, Sandman does not guarantee the completeness, accuracy, or availability of third-party data and reserves the right to correct errors, update information, modify Contest data, or change data providers at any time.

The version of these Rules in effect at the time of deposit and/or contest entry shall govern that Contest unless otherwise required by law. Sandman reserves the right to modify these Rules at any time. Any modifications shall apply prospectively and shall not affect Contests that have already begun unless necessary to address legal, regulatory, security, technical, compliance, or integrity concerns.

User Skill Tiers

Rookie Beginner 50 or fewer Contests played.
Veteran Experienced 51-999 contests played, OR won $1,000+ in at least 2 separate Contests, OR won $10,000+ in total prizes across all Contests.
All-Star Highly Experienced 1,000+ contests played, OR won $1,000+ in at least 3 separate Contests, OR won $25,000+ in total prizes across all Contests.

Contest Types

Contest Type Description
Survivor ¹ Pick a winner each week. Lose once and you're out. Last entry standing wins.
Pick'em ² Predict the outcome of every selection on the slate. Most correct picks wins.
Tiers ³ Players are grouped into tiers. Pick one from each tier and compete using their combined score.
One & Done ¹ Pick one player each week. Once you use them, you cannot use them again for the remainder of the season.
Advancement / Bracket ¹ Build a new lineup each week around specific statistical categories and compete in a head-to-head single-elimination bracket. Winners advance through the bracket until only one entry remains to be crowned champion.
Confidence ² Predict the outcome of every selection provided and rank them by confidence. Your highest-confidence picks are worth the most points.
